Terms of service summary for customers
Service overview
BabyQuip provides a platform connecting customers with independent Quality Providers who rent clean, safe, and insured baby equipment. Quality Providers are independent contractors, not BabyQuip employees.
As a BabyQuip customer, you agree to:
- Provide accurate information when creating an account and placing orders
- Use rented equipment only as intended by the manufacturer
- Return all equipment in the condition it was received
- Not modify, damage, or misuse rented equipment
- Not smoke near any rented equipment
- Supervise children using rented equipment at all times
- Pay all applicable fees and charges on time
Fees and payments
- Payment is required at the time of booking
- The service fee is non-refundable (except when a Quality Provider cancels)
- Additional fees may apply for delivery outside service areas, after-hours delivery, or holiday delivery
- Additional cleaning fees ($25 per item) may apply if equipment is returned excessively dirty
- You are financially responsible for lost, stolen, or damaged equipment
Cancellation and refunds
- Cancellation policies vary based on your location and whether you purchase Cancel For Any Reason (CFAR) protection
- Without CFAR, cancellations 15+ days before reservation receive full refund minus service fee; cancellations within 14 days are non-refundable
- With CFAR, you can cancel for any reason before the start time and receive a full refund minus CFAR fee
- All cancellations must be made through the BabyQuip platform, not by contacting Quality Providers directly
Damage protection
- You are responsible for all rented equipment during your rental period
- For accidental damage or loss between $25-$1000, the BabyQuip Damage Protection Plan provides coverage with a $25 deductible
- You are fully responsible for damages below $25 and above $1000
- Damage from misuse, negligence, or violation of manufacturer guidelines is not covered
Liability limitations
- BabyQuip provides a $1,000,000 liability insurance policy on all rentals
- BabyQuip is not responsible for injuries resulting from improper use of equipment
- Quality Providers do not install car seats due to liability reasons
- BabyQuip's total liability is limited to the amount you paid for your rental
- BabyQuip is not liable for indirect, incidental, special, or consequential damages
Dispute resolution
- You agree to resolve any disputes through binding arbitration rather than court proceedings
- Arbitration will occur in San Francisco, California
- Class actions and jury trials are waived
- Small claims court cases are exempt from mandatory arbitration
- You have 30 days after accepting these terms to opt out of arbitration by emailing legal@babyquip.com
Privacy and data collection
- BabyQuip collects personal information to process orders and improve services
- Payment information is securely processed through our payment processor
- BabyQuip does not sell or share personal information with unaffiliated third parties
- You can request deletion of your account and data by contacting support@babyquip.com
Service modifications
- BabyQuip may modify the Terms of Service at any time
- Continued use of the platform after changes constitutes acceptance of modified terms
- BabyQuip reserves the right to suspend or terminate accounts for violations of terms
- BabyQuip may add, modify, or discontinue services or features at any time
Intellectual property
- All BabyQuip content, trademarks, and features are owned by BabyQuip
- You may not copy, modify, or redistribute BabyQuip materials without permission
- You grant BabyQuip the right to use your reviews, feedback, and photos related to the service
